Bear Trail Bikes: Terms & Conditions

1. Overview Welcome to Bear Trail Bikes. By purchasing from our website, in shops or attending a distribution event, you agree to the following terms and conditions. These terms ensure transparency regarding pricing, eligibility for the Colorado E-Bike Tax Credit, refunds, and order fulfillment.

2. Eligibility for the Colorado E-Bike Tax Credit Bear Trail Bikes is a certified retailer under the Colorado E-Bike Tax Credit Program. This program allows eligible Colorado residents to receive an instant $225 discount on qualifying e-bike purchases.

  • You must be a Colorado resident and complete the Colorado Residency Affidavit.
  • You must provide valid proof of residency (driver’s license or state ID) at pickup.
  • Failure to present valid proof of residency will make the order ineligible for the credit, and the $225 discount will be removed.

3. Assembly and Customer Responsibility Bear Trail Bikes does not provide assembly services. All bicycles are provided in their original manufacturer’s box. It is the sole responsibility of the customer to build, tune, and safety-check the e-bike. Bear Trail Bikes is not liable for any damage or injury resulting from improper assembly.

4. Manufacturing Defects & Warranty Claims While Bear Trail Bikes does not offer an independent shop warranty, we will assist with manufacturer-related issues.

  • Manufacturing Defects: In the event of a suspected manufacturing defect "out of the box," the bike must be returned to the shop for inspection.
  • Facilitation: If a defect is confirmed in a component covered by the manufacturer’s warranty, we will facilitate a replacement or repair according to the manufacturer’s specific terms.
  • Exclusions: This does not include normal wear and tear or damage caused by misuse, accidents, or improper assembly by the customer.

5. Returns and Refunds (All Sales Final) Due to the immediate application of the $225 Colorado E-Bike Tax Credit, all sales are final once the bicycle has been picked up and has left our premises. No returns or exchanges will be accepted after this point. Per Colorado DOR Rule 39-22-555, the tax credit is only valid for new, unreturned bicycles. By removing the bicycle from the shop, the purchaser acknowledges it is in new condition.

6. Free E-Bike & $99 E-Bike Program Disclaimer
Customers acknowledge that all timelines provided, including the 6–12 week timeframe, are estimates only and are not guaranteed. Due to high demand and program constraints, fulfillment times may vary.

Specific e-bike models, styles, and color selections are not guaranteed. Bear Trail Bikes reserves the right to substitute any free or $99 e-bike with a comparable or qualifying model based on availability, including models that differ in style (e.g., folding vs. mountain) so long as they meet the requirements of the Colorado e-bike tax credit program.

All orders are subject to availability under the free e-bike program. Bear Trail Bikes reserves the right to determine eligibility and fulfillment based on available inventory and program guidelines.

E-bikes are not shipped. All orders must be picked up in person, and customers are required to verify Colorado residency at the time of pickup.

By participating in this program, customers agree to these terms.

7. Pricing and Payments All prices listed on our website are in U.S. dollars. Full payment is required at the time of checkout to secure your order.

8. Pickup and Shipping

  • Free pickup is available in Denver and Rifle, Colorado.
  • Proof of residency must be shown at the time of pickup to finalize eligibility.

9. Program Changes The Colorado E-Bike Tax Credit program is managed by the State of Colorado and may change at any time. Bear Trail Bikes is not responsible for any state policy adjustments or eligibility revisions.

10. Time Frame By placing an order, customers acknowledge that electric bikes have an estimated processing and arrival timeframe of 6 to 12 weeks before becoming available for pickup. Please note that this is an estimate and may be subject to change. If your order extends beyond this timeframe, we will communicate updates accordingly.
